# WCD estate status — October 26, 2026 (ANCHOR edit of the October 21 Manus note)

## Primary-source findings as of October 26, 2026

**No confirmed plan / no operating trust.** The reviewed official public record establishes no confirmed plan, operating Section 524(g) trust, trust payment percentage, or trust claims process. Docket 1468, the October 28, 2024 proposed plan, defines the Tort Claims Trust as prospective, effective-date-dependent. The case-agent page lists disclosure-statement and tort-bar-date hearings for **December 10, 2026, 11:30 a.m. Eastern**; these are not approved filing deadlines or trust-opening notices. Trust metrics remain null/not applicable, not zero. [2] [6]

**$535 million estate settlement: approved in an October 22, 2026 opinion; order to follow.** Docket 3013: “the Settlement Motion is GRANTED.” No order on the settlement had been entered at the October 26 docket check (newest entries: monthly fee statements). Docket 1297 sought approval of aggregate estate consideration from the “Settling Non-Debtors” (the Brenntag entities, NICO, and DBUS), not trust assets or a claimant payout. The earlier Committee filings (Docket 2791, July 14; Docket 2876, August 7) described the motion as contested; the opinion resolved it. Financing reduces the later cash contribution; no current distributable balance was calculated. **Both Supreme Court petitions remain pending on the retrieved public dockets (re-checked October 26), but November 6 applies only to 26-263.** In **26-159**, the receiver matter, opposition was filed **August 25**, and reply **September 4**, its latest shown entry. In **26-263**, the Committee’s estate-property matter, the September 14 entry extends all respondents’ responses through **November 6**; October 8 amicus entries are latest, with no opposition or disposition shown. The draft corrects the work order’s dual-November-6 premise. [7] [8]

**Appellate holding:** the amended April 27, 2026 opinion upholds the board-authorized filing and holds the product-line claims at issue to be estate property under §541(a)(1). It neither approves the settlement nor creates a trust. The draft explains estate control and distribution without treating every direct claim against Brenntag as barred. [1]

## Remaining review questions

Manus checked the public bankruptcy docket through **Docket 3007, October 20, 2026**. ANCHOR re-checked it on October 26 through **Docket 3019**: Docket 3013 (October 22) grants the settlement motion; no order on it had been entered. The December 10, 2026 hearing listings were re-confirmed on the case-agent page October 26. Restricted, delayed, sealed, or later filings remain outside this check.
